How Do I Protect My Legal Rights After a Car Crash?

Immediately following a car accident, focus on your health and safety. Call 9-1-1 to report the accident to police and ask for an ambulance if you need medical care. Get out of the roadway and move to a safe place. After you are safe and your injuries are taken care of, we recommend you follow these guidelines:

  • Take photos of the scene of the collision, your injuries, and the damage to your car.
  • Keep copies of any medical records or bills, repair receipts, wage loss records, and any other related expenses.
  • It is important that you do not give a recorded statement to the other party’s insurance company, do not admit fault for the accident, and do not sign anything (i.e. any forms from an insurer).  Insurance companies are eager to take      advantage of accident victims who don’t know their rights. Their objective is to limit or deny claims payouts.
  • Contact an experienced lawyer to learn the full value of your case and your rights in the matter, to avoid making any mistakes that the other driver’s insurance company can use against you.

How Does Louisiana Car Accident Law Work?

Louisiana law allows injured drivers and passengers, and the families of loved ones who have died or in car accidents, to make a claim and file suit against those responsible for the accident.

Legal responsibility, called “liability,” for a car accident often depends upon proof that the driver was negligent, and therefore at fault.  Proving the other driver operated the vehicle in an unsafe and unreasonable manner under the circumstances, is sufficient evidence to demonstrate liability.

Keep in mind that under Louisiana law, the deadline to bring a lawsuit for a car accident is one year.

What Compensation Can I Obtain If I File a Car Accident Lawsuit?

The damages available to injured in a car accident include:

  • Past and future physical pain and suffering, mental anguish, and physical impairment;
  • Past and future medical, incidental, and hospital expenses;
  • Past and future loss of earnings and lost earning capacity;
  • Property damages;
  • Loss of enjoyment of life damages;
  • Punitive damages in cases of drunk drivers; and
  • Wrongful death damages and survival action damages for a victim killed in an accident.

Mesothelioma is a brutal and devastating disease. Mesothelioma only has one known cause: exposure to asbestos. Asbestos was commonly used in construction materials and industrial settings. Items such as insulation, pipe covering, joint compound, shingles, tile, and cement commonly contained asbestos. Companies in Louisiana and the manufacturers of asbestos are responsible to their workers for asbestos exposure. If you are diagnosed with mesothelioma, call the Nicholson Law Firm at 225-281-7715.

Pharmaceutical & Medical Device Litigation

Thousands of people across the United States are injured every year because of defective drugs and medical devices. Manufacturers have a financial incentive to push new drugs and medical equipment to market before they fully understand the associated side effects and dangers. Manufacturers also sometimes under-report side effects and bad results, so that drugs they have invested in, that may not be effective or reliable, make it to market anyway.

The FDA relies upon manufacturer reports of the safety and reliability of a drug or device and FDA approval does not mean a drug is safe. The Nicholson Law Firm scrutinizes the evidence to hold drug and medical device manufacturers accountable when they place profit over safety.

The Nicholson Law Firm has experience recovering large amounts for our clients for the negligence of these manufacturers and is committed to recovering compensation for our clients that have suffered these types of damages.
